Terms of Service

1. Acceptance of Terms

By accessing or using PeriCatch ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

PeriCatch is an educational clinical decision support tool that helps individuals organize perimenopause and menopause symptoms for discussion with their healthcare providers, and helps licensed clinicians structure perimenopause and menopause assessments using evidence-based guidelines. PeriCatch is built and maintained by a board-certified family medicine physician.

3. Clinical Decision Support Disclaimer

PeriCatch is a clinical decision support aid. It does not provide medical diagnoses, prescribe treatments, or replace the independent clinical judgment of a licensed healthcare provider.

For individuals: PeriCatch is a pre-visit preparation tool that helps you organize your symptoms to prepare for a conversation with your healthcare provider. It is not a diagnosis and does not replace professional medical advice.

For clinicians: PeriCatch supplements, but does not replace, your own clinical judgment. All staging estimates, treatment considerations, and documentation suggestions require your independent clinical review. All clinical decisions remain your professional and legal responsibility.

4. Intended Users

The clinician tool is intended for use by licensed healthcare providers in the course of their clinical practice. The individual preparation tool is intended for adults seeking to organize their symptoms before a healthcare visit.

5. Data Practices

PeriCatch uses server-side processing to protect proprietary clinical decision logic. When you submit an assessment, your symptom and history data is sent to our secure servers, processed by our clinical algorithm, and the results are returned to your browser.

Your data is processed in real-time and is never stored, logged, or retained on our servers after processing is complete. No personally identifiable health information is persisted at any point in our infrastructure. After the server returns your results, the input data exists only in your browser session and is discarded when you close or navigate away from the page.

No account, login, or personal identifier is required to use the assessment tools.

6. Future Data Collection

If PeriCatch introduces features that collect, store, or transmit personal health information in the future (such as saved assessments, user accounts, or longitudinal tracking), we will update this Terms of Service and Privacy Policy before any such feature is activated, and will obtain explicit consent.

7. No Provider-Patient Relationship

Use of PeriCatch does not create a provider-patient, physician-patient, or therapeutic relationship between you and PeriCatch, its developer, or any affiliated party. PeriCatch is a software tool, not a healthcare provider.

8. Informational Content Disclaimer

Clinical information presented by PeriCatch, including staging estimates, treatment considerations, and guideline references, is derived from published, peer-reviewed sources (STRAW+10, The Menopause Society, ACOG, AHA). This information is provided for educational and clinical support purposes. It may not reflect the most recent evidence or apply to every individual clinical scenario.

9. User Responsibilities

You are responsible for verifying any information provided by PeriCatch against current clinical sources before making healthcare decisions. If you are experiencing a medical emergency, call emergency services immediately.

10. Intellectual Property

The PeriCatch clinical algorithm, staging decision tree, treatment eligibility logic, free-text parser, and associated clinical decision rules are proprietary. The STRAW+10 staging framework itself is published clinical knowledge (Harlow et al. 2012); PeriCatch's computational implementation of that framework is proprietary.

You may not reverse-engineer, decompile, or attempt to extract the source code or clinical logic of PeriCatch.

11. No Warranty

PeriCatch is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of Liability

To the maximum extent permitted by applicable law, PeriCatch, its developer, and affiliated parties shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.

13. Acceptable Use

You agree not to use PeriCatch to: (a) provide medical advice to others without appropriate licensure; (b) attempt to extract, copy, or reverse-engineer the proprietary clinical algorithm; (c) submit false or fabricated clinical data; (d) use the Service for any unlawful purpose.

14. Modifications

We may update these Terms at any time. Material changes will be indicated by updating the "Last updated" date. Continued use after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
